Drinking on a party bus in Texas, the actual rule
Texas Penal Code 49.031 treats an open container in a vehicle's passenger area as a Class C misdemeanor, and then excepts a passenger in a vehicle "designed, maintained, or used primarily for the transportation of persons for compensation," naming buses and limousines specifically.
- The exception is for passengers. Your chauffeur stays dry, by law and by policy.
- Texas has no statewide BYOB restriction.
- Ice, cups, and cold soft drinks come aboard with the bus. Alcohol included in the fare is a sale under TABC rules, so bring your own.
