Texas Penal Code 49.031 treats an open container in a vehicle's passenger area as a Class C misdemeanor, and then excepts a passenger in a vehicle "designed, maintained, or used primarily for the transportation of persons for compensation," naming buses and limousines specifically.

The exception is for passengers. Your chauffeur stays dry, by law and by policy.
